A township of Michigan

Ellington Township is located in Tuscola County in what is known as the Thumb of Michigan. It sits on the northeastern outskirts of the city of Caro, Michigan, which is also the seat of Tuscola County. Ellington township is located between Caro and Cass City.

The township is 35.6 square miles of mostly residential, farmland, and state gaming area. As of the 2010 Census, the population was 1,332.

NOTICE OF ADOPTION: ORDINANCE NO. 2021-07O, AN ORDINANCE TO AMEND ZONING ORDINANCE REGARDING SOLAR ENERGY CONVERSION SYSTEMS
To the residents and property owners of the Township of Ellington, Tuscola County, Michigan, and all other interested persons: On July 13, 2021, the Township of Ellington (the "Township") adopted Ordinance No. 100, an Ordinance to Amend Zoning Ordinance Regarding Solar Energy Conversion Systems ("Ordinance"). A summary of the Ordinance is provided below. A true copy of the Ordinance, including any exhibits, is available for inspection at the Township Hall, 2791 East Caro Rd., Caro, MI, and is posted on the website of the Township of Ellington, ellingtontownship.org.

Section 1. Amendment of Article 5 – Section 5.02(A). This section amends Section 5.02(A) to clarify the requirement that private parks, recreation facilities and activities, campgrounds and golf courses located in the AFR Agriculture - Forestry - Residential District shall be adequately screened from adjoining property.

Section 2. Amendment of Article 5 – Section 5.02(N). This section comprehensively amends Section 5.02(N) to provide special land use process and requirements for solar energy systems. Among other things, the section provides regulations and requirements related to the location and placement of solar energy systems; maximum height restrictions; setbacks from property line; nuisance mitigation; special use permit procedure and standards; enclosure requirements; construction code and interconnection standards; maximum noise level; decommissioning; liability insurance; environmental impact analysis; compliance and penalties; and other solar energy system ownership and operation requirements.

Section 3. Amendment of Article 8. This section amends Section 8.02 to authorize Commercial Solar Energy Systems as special land uses in the C Commercial Zoning District.

Section 4. Amendment of Article 9. This section amends Section 9.02 to authorize Commercial Solar Energy Systems as special land uses in the I Industrial Zoning District.

Section 5. Amendment of Article 11. This section amends Section 11.01(H) to provide that all illumination for off-street parking areas shall be deflected away from adjacent property lines.

Section 6. Amendment of Article 21. This section amends Section 21.01 to provide definitions for the terms: “Adjacent”, “Rear Lot Line”, “Yard, Front”, “Yard, Rear”, and “Yard Side” as used in the Ordinance.

Section 7. Validity and Severability. This section provides that if any portion of the Ordinance is found invalid for any reason, such holding shall not be construed as affecting the validity of the remaining portions of this Ordinance.

Section 8. Repealer. This section provides that any ordinances or parts of ordinances in conflict with the Ordinance are hereby repealed only to the extent necessary to give the Ordinance full force and effect.

Section 9. Effective Date. This section provides that the Ordinance shall take effect seven days after publication.

NOTICE OF ADOPTION: ORDINANCE NO. 2021-06O, ELECTRIC AND FIBER FRANCHISE ORDINANCE
To the residents and property owners of the Township of Ellington, Tuscola County, Michigan, and all other interested persons: On July 13, 2021, the Township of Ellington (the "Township") adopted Ordinance No. 2021-06O, Electric And Fiber Franchise Ordinance ("Ordinance"). A summary of the Ordinance is provided below. A true copy of the Ordinance, including any exhibits, is available for inspection at the Township Hall, 2791 East Caro Rd., Caro, MI, and is posted on the website of the Township of Ellington, ellingtontownship.org.

Section 1. Grant. This section grants Thumb Electric Cooperative (“TEC”) a public utility franchise to provide electricity and electrical and broadband internet services to the Township and grants TEC use of public right of ways to provide such services.

Section 2. Term. This section provides the term of the Franchise Agreement as thirty (30) years.

Section 3. Consideration. This section acknowledges the consideration provided for the Franchise Agreement.

Section 4. Conditions. This section provides terms and conditions governing the Franchise Agreement, which includes but is not limited to, the Township’s right to impose rules and regulations governing TEC’s performance of services and use of public right of ways.

Section 5. Vacation or Relocation. This section reserves the Township’s right to request that TEC vacate or relocate electric or fiber systems for the public health and welfare.

Section 6. Hold Harmless. This section provides that TEC will indemnify the Township for claims and damages caused by TEC’s negligence in the construction, operation, or maintenance of its property within the Township.

Section 7. Franchise Not Exclusive. This section provides that the rights and powers provided under the Franchise Agreement are not exclusive.

Section 8. Rates. This section provides that TEC may charge Township residents for services provided using a rate for services approved by the Township.

Section 9. Revocation. This section provides that the ordinance may be revoked upon written notice of either party within sixty (60) days of its adoption.

Section 10. Jurisdiction. This section provides that TEC is subject to all Township ordinance, rules and regulations to the extent authorized by law.

Section 11. Effective Date. This section provides that the Ordinance shall go into effect thirty (30) days after the date of its adoption, unless TEC fails to provide written acceptance of the Franchise Agreement within the thirty (30) day time period.

NOTICE IS HEREBY GIVEN that a Ellington Board of Trustee special meeting is scheduled for July 22, 2021, at 7:30 pm. The meeting will be held at the Ellington Township Hall located at 2791 East Caro Road to discuss the American Rescue Plan dollars that the township can apply for before July 27, 2021. NOTICE IS HEREBY GIVEN that the Ellington Public Board of Review is scheduled for July 20th, 2021, at 6:00pm.  This meeting will be held at the Ellington Township Hall located at 2791 East Caro Road. The purpose of the July BOR is to correct clerical errors and the board will also hear applications for current year poverty exemption, but not a poverty exemption denied by the March board of review. ♦ NOTICE IS HEREBY GIVEN that a meeting of the Ellington Township Planning Commission will be held on May 26, 2021 at 7:30 p.m. at the Ellington Township Hall, 2791 East Caro Rd, Caro, MI.

 At this meeting, the Planning Commission will consider and hold a public hearing on proposed amendments to the Township Zoning Ordinance ("Zoning Ordinance"), which regulate solar energy systems in the Township.  The proposed amendments would, among other things, update terminology associated with solar energy systems and amend the requirements for solar energy systems. 

The Planning Commission is receiving written comments concerning the proposed amendments.  Comments must be received by the Township prior to the start of the public hearing. A complete copy of the proposed amendments is available at the Township Hall. (A Link to the proposed changes.)

NOTICE IS HEREBY GIVEN that at its meeting on March 9, 2021, the Township Board for the Township of Ellington approved a Resolution To Extend Moratorium On The Issuance Of Permits, Licenses, Or Approvals For, Or For Any Construction Of, Large Solar Energy Facilities which extends, for an additional six (6) months or until such time as Large Solar Energy Facility regulatory amendments to the Township's Zoning Ordinance become effective, whichever occurs first, the moratorium on the issuance of any and all permits, licenses, or approvals for any property subject to or under the jurisdiction of the Township's Zoning Ordinance for the establishment or use of Large Solar Energy Facilities. Public meetings will be held on March 8, 2021, at 3pm-9pm; and March 9th, 2021, at 9am-3pm.   The Board of Review will meet to hear questions, protests, and equalize the 2021 assessments. Appointments are strongly encouraged.
